Ciba & others, Pl help, FP record not received by INS

Hi,

ND - 8/00, ID- 2/98, EB2- RIR. We have done our FP on 1/27 & 2/20. We immediately checked with the FBI. They said it is all cleared and sent on the same day to INS. . Now our attorney found out the FP records have not reached the INS. It is almost three years. Please let us know how to proceed. Kindly give us the phone number for attorney inquiry and the form number for attorney ax inquiry and any other phone number that would be of use. Anyone with similar experience.

Ammo how did attorney know INS has not received FP...I am almost 100% sure its wrong..call IIO and give them your wac and A number and I am sure they will locate it...If not then call FBI again and tell them ur story...FBI will take ur contact number and then call INS and check and call u back..FBI PR is really good at it....Insist on FBI that INS says they have not received your FP.

Thanks for the reply. Did you have any such experience? I have called the FBI to day and they once again confirmed that the records have been sent as soon as the FP is done. When I requested them to resend it again, they said that the request has to come from INS to their INS laison office. I am trying to reach the IIO office - but not successful. I was told that there is priviledged number for attorneys to call the INS. My attorney does not know about it. If anyone knows the number please let me know. I can ask my attorney to reach through that number INS and get more info.

I too have the same question as debo: how did your lawyer
find out that CSC has not received your finger prints?
Normally, if FBI has confirmed sending out the results,
it is almost certain that they reach the destination
smoothly. One thing might go wrong is that FBI may
sent the results to wrong service center. Even that
is not a big deal, as four service centers seem to have
access to all FP results.

There are indeed speical phone and fax numbers that are
only known to attorneys to communicate with INS directly.
However, no lawyer would want to give them out because the
phones will soon be clogged up and become useless. One
time a folk asked Ron about the numbers, Ron did not want
to give them out for the same reasons.

I think debo makes very good suggestions. You can approach
FBI again and ask where the results were sent to. Also,
talk to you lawyer why he thinks CSC does not have your
finger prints. It\'s possible that it\'s miscommunication.

Thanks for your reply. We were asking the lawyers to check the I-485 status, since we saw many cases filed even during 2001 were getting approved, however ours filed in August 2000 (EB2-RIR) was still not coming through. The lawyers talked to IIO at CSC and learnt that our FP records are missing. Then the lawyers called FBI, FBI too told them that they could not locate the FP. The lawyers were planning for re-doing the FP all over again.

Then next I myself called the FBI and located the record records using my last and first name. (** Please note, we were told FBI deletes all A# number ref. and go only by First / Last name after few months of doing FP). My first name has two words with a space in between. My lawyers used my name without the space and try to trace it. While I did the FP, I specifically made sure the way INS has in its records and filled out FP forms to match. I also got the confirmation from FBI that mine as well my spouse FP were cleared and sent to INS immediately.

We asked the FBI to resend the FP records to INS-CSC. They said they can not do so on their own. The INS-CSC has to request the INS liaison office located at FBI office to get the FP records. Now we are trying to reach INS-CSC to make that request. Attorney is planning to send a FAX to INS-CSC requesting them to locate the FP records, however they feel that we may end-up doing a fresh FP, which means another 4 to 5 month wait time. We are in very critical stage, and this news put us down very badly. I would appreciate if you can throw some light.

Ammu,

Your FP senario looks very complicated. I still fail to understand
why FB1 confirms sending out results and yet INS tells you that the
results cannot be found.

If you cannot sort things out, go ahead redo the finger prints.
It won\'t take another 4 or 5 months as you fear. From the
information we have gathered so far regarding finger prints,
the process seems to work like this: examiner first looks into
your files, once it is ready for adjudication, he/she checks
whether your finger prints are OK, if they are, your case will
be adjudicated.

This is why many people get their cases approved shortly after
finger prints. I suggest you redo your finger prints as soon
as possible. It does not hurt if you have two sets of FP.

Appreciate your reply. Do you have any idea as to how long would it take for getting an appontment for FP if we request for rescheduling. Our attorney is sending out a request today.

Hi ammu,

I don\'t know how long it takes to get a finger print notice.
If your lawyer sent a formal request form, my guess is it
should take no more than a few weeks. Alternatively, you
can go to the local INS office near you and explain to them
that your finger print results are "lost". They could issue
you a notice there. San Jose office is especially helpful
in this regard.
