Christmas Letter

Hi everyone.

My husband received a christmas letter from USCIS (for those of you who don't know - his name check has been pending for 2.5 years). Here is its contents:
Dear Applicant for Naturalization,

This letter is to inform you that it has become necessary to continue your naturalization petition because of new procedures we have instituted to improve the background check process for naturalization applicants.

Under our new policy, effective November 13, 2002, we cannot naturalize applicants until the background check procedures are fully completed. These new procedures apply to all applicants. Unfortunately, we have not yet completed the background check process in your case in time to schedule a naturalization ceremony date.

We apologize for any inconvenience. You may be assured that your naturalization petition will be processed immediately upon receipt of all the required documents. You may notify us of any changes in your mailing address by calling 1-800-375-5283 or by writing to the address listed below:
address

Sincerely,

Jane Arellano
District Director

I'd like to write a "thank you" letter to Ms Jane Arellano (who, by the way, never bothered to respond to my letter about this case) for still remembering my husband and his naturalization petition, and for sending us this letter with the same info they have been giving us for the last year. Maybe they think he forgot about it, and this is their way of reminding my husband of his own petition...
What do you think?
Has anyone gotten the same greeting for Christmas?
Merry Christmas to all of you :)

Do they mean "Continue" in the same way that a court hearing is "Continued", ie processing is stopped temporarily?

His case is being 'continued..." e.g. "pending" for 2.5 years. I think that's what they are referring to - continue with his background checking.

Hmm, if a 2.5-year wait is an "improvement", how long did it take before that "improvement"???
and it's not even over yet...

In my opininion, your Thank you letter should be a Petition for a Hearing under 8 USC 1447b.

I still don't understand why you are waiting for so long to sue them. Look at Steve_Houston, he had his interview in June 2005, filed a suit in July 2005 and now he will be a citizen in January 2006. Your husband on the other hand is waiting for over 2.5 years. Come on, take action...NOW.

delays in determination are a matter of national security

I think it is a matter of national security if the background check process/name check etc take over a month. So if there is a terrorist amongst us, are the authorities going to take 2 years to determine if the person is squeky clean or not? Often national security is a reason given by USCIS as reason for delay - when in fact the delay in determination itself is the weak link the national security effort.

I agree with you, Publicus. But it is not my case, and I am not the one to take action.
Thanks for your concern, though.

This PUBLICUS guy is terrible, always a step ahead of others. But he's right. The best Christmas present you can send to "Miss Jane" is a summon from District Court. And since is your husband case, assuming that you care about him, is your case too. You look like an entrepreneurial person; then you can prepare the papers and him just have to sign on the bottom.
And to give them what they deserve, ask you husband to send them a picture of his middle finger oriented vertically... :D
Have a Marry Christmas and a Happy New year! :)

Vulpasin, don't you think it is a good present: A lawsuit...It's the best. I am sure it's memorable. :D

You forgot to mention that as a sign of love and old friendship the finger should highly and proudly be directed upward. Toward the sky. :D

Take it CIS...Take it...:D

You're absolutely right, I said verticaly but I forgot to mention upward...all the way up :D :D :D
And about the lawsuit, definitely is the best present, but the other one is just, like you said, our symbol of love and sympathy we cultured inside of us years after years for this beautiful and glorious institution: INS.
