I applied for my Petition to Remove Conditions of Residence Form I-751 and receives A Notice Of Action:
Submit copies of documents indicating that the marriage upon which you were granted conditional status was entered in "good faith...."
Examples include, but are not limited to Documentation of children resulting from the relationship, I have a 3mth old son, my husband is not the father of this baby nor does he want his name on the birth paper. My son is currently carrying my maiden name as I can located the supposed father. [/B][/B]
Will this have a negative effect on my application?
We were also denied life insurance because I am a cancer patient,
We live with friends so there are no bills or lease in our name. We are in a terrible rough patch, our bank account has been closed due to over draft.
WHAT ADVICE IS THERE FOR US - we have to return documents by Feb 26th 2010.

I am confused. Did your current husband or an ex-husband petition for you?

If your current husband petitioned for you initially and you have a child by another man, you have a great problem overcoming a good faith marriage presumption.

If it is for your ex-husband's petition, you need to supply the documentation pertaining to your former marriage. (Lease with your and former husband's names, etc.)

You need to consult a family law attorney as in many states, a child born into a marriage is assumed by law to be the child of the husband and wife unless the "real" father takes action to establish paternity.

You really should consider visiting Catholic Charities' (or other social service agency dealing with immigrantion issue) legal clinic or the legal clinic at the local law school.
