Hello All,
I applied for a I-130 and I-485.I have my interview on September 15.I am married to a USC who has a 10 year old kid out of wedlock. In all of the applications filled out we were asked if there were any children from previous marriage.I put none as he was never married before.Only in I-864 I put in 1 extra dependent for the tax forms. My question is if in the Interview we are asked if we have any children or any children from previous marriage should we mention anything about the child ? Will it make things complicated?
He has full custody of the child since she was 3.Her bio mother is in jail and wont be out for another 10 years.
Please help

Where was this child born? If the child was born in the US, then she is a USC and has no bearing on your petition. The I-485 is for your the beneficiary, not the USC. In your case, if this was your child and was born outside the US, but WAS or NOT present with you in the US, you will be required to list her in the application so she can gain the same GC as yourself. If your USC spouse was married before, it has nothing to do with you as long as you weren't the 1st and 2nd wife...

In listing this child in the I-864, you did the right thing because she's dependent on her dad for support. At the interview, you can explain to the IO that this child is your step-child b/c you are now married to her father. Remember to be truthful and NOT say what sound RIGHT. You have nothing to worry about here, I see no issue at all. She is your daugther now and all that matters before USCIS is that your marriage is bona fide and NOT to evade immigration laws of Uncle Sam...:)

Lastly, USCIS doesn't serve as the moral police for what people do in the privacy of their bedroom at night, that is for Republicans....:D:D In order words, your husband has every right to have this child, and has all legal documents showing that he's the biological father of this girl. In any way, USCIS won't care much about his daughter...it's out of their domain..:)
