Child Citizenship Act of 2000

This is regarding my citizenship status I just would like a few suggestions.
My father had became a naturalized U.S. Citizen in May of 2007. Based upon the Child Citizenship Act of 2000 a child becomes a U.S. citizen automatically if all the requirements are met.

* Have at least one American citizen parent by birth or naturalization;

* Be under 18 years of age;

* Live in the legal and physical custody of the American citizen parent; and

* Be admitted as an immigrant for lawful permanent residence

Based on everything I have stated above I became a (LPR) Green card holder in 1998.
I have a translated birth certificate from my country showing that I was under 18 years old at the time.
I also have school records showing that me and my father resided together.
I have my Green card with me and a copy of my fathers naturalization certificate showing that I was still under 18 on the date that he became a U.S. Citizen.

I had left the U.S. in April of 2007 cause of some family issues back home and was in a hurry and did not have any time to apply for my passport. So I left with my country’s passport and now I would like to return
to the U.S. but not sure if I’ll get denied entry by the U.S. customs. Could I simply show them this info that I have stated above?… could they verify my citizenship without me obtaining a U.S. passport?…
It takes a long time trying to receive a certificate of citizenship I have already sent an N-600 form.
I have read in an article saying that it takes about a year or more to get the certificate.:confused::confused::confused:

Any help would be real helpfull:)

Can you go to one of USCIS' offices outside of America with that information? They may be able to give you a passport right there. It would help if your father would be with you when you go.

You left US before your father naturalized. In order to qualify for citizenship under the CC2000 act; you must be under 18 AND in physical custody of your parent(s) in the US. If you are under 18 now and return to US, you can apply for a US passport using your green card, your birth certificate and your father's passport/naturalization certificate as supporting documents. If you are over 18 when you return you cannot claim citizenship thru CC2000. You will then have to get naturalized the regular way (N-400).

Like nkm said, it looks like you are NOT a US citizen, because you were not in the US at any time on or after your father's naturalization.

Now that it has been more than a year that you've been outside the US, your green card is no longer valid by itself to reenter the US. And since you left in such a hurry I figure you don't have a reentry permit. So you have to apply for an SB-1 visa now.

Lesson learned: If you were not born in the US, do NOT assume you are a US citizen without having a US passport or citizenship certificate in your hand.
