Hi,

After I get Citezenship what are the steps to get my child citezenship who is overseas now:

1- Can I apply US Passport for my child from US Embassy?
or
2- Apply N600 than apply US Passport?
or
3- Apply I-130 after how many years holding GC can I apply for my child N600 and US Passport?

We need to know more about the circumstances to give you an opinion. Is the child out temporarily on vacation? Permanently residing abroad? Does the child have a green card? Do you have custody of this child? Please give some more details.

My 2 cents.

Probably not. First you need to familiarize yourself with the requirements of the Child Citizenship Act of 2000, then you need to consider you child's circumstances.

i. are they a GC holder
ii. are they living in your custody (doesn't sound like it)
iii. are they able to be legally and physically present in the US

2- Apply N600 than apply US Passport?
Maybe N-600K would be appropriate, but again you hit the stumbling block of whether the child lives in your custody.

3- Apply I-130 after how many years holding GC can I apply for my child N600 and US Passport?
Once the child legally enters the US as an LPR, they would automagically become a USC if they are in your custody. An I-130 and CP in the IR category typically takes 9 months or so.

I believe there are other corner cases which could benefit him, even while the son is out of the country, but I refuse to say more unless the poster becomes a bit more forthcoming about this case circumstances. I hate to write long treatises because the poster doesn't provide enough details.

My 2 cents

Thanks all for your reply.

This is the information:
1- My child is residing abroad with my wife "mother" of my child.
2- No green card
3- My child is in my custody but as you known I can not bring him and his mother here in USA that why are leaving abroad.

My question was how can my child be us citizen after I be US Citizen, for process what step (1 or 2 or 3) that I have to follow up?
For the mother I known that I have to apply I -130 for here, I am looking short way for my child.

Ok, for all my bragging I don't have much to say now ;) I thought your case was going to fall under INA 320, but the way you describe it this is not the case. I agree with boatbod comments about N-600K, but I have to say I don't have any experience with N-600K, it seems the child has to be temporarily in the U.S.. I hope someone else with experience can pitch in. One avenue would be to apply for Green Card for both your wife and your son. As soon as your son gets admitted as permanent resident he will automatically become a U.S. citizen.

Its probably quicker to get your wife and child a GC than it is to apply for N-600K. USCIS seem notoriously slow at processing N-600 cases (just ask Flydog).

Thanks all for your input.

So I have to apply I-130 for him.
is it faster If I could bring my child on visit visa then can I apply US Passport for him

No, you cannot bring your child on visitor visa and apply for U.S. passport, that would be illegal. He is not a citizen.

Once you get naturalized, your child who is not a Green card holder(living in US or abroad) can not get a US citizen. When you get your US citizenship, fill out form I-130 for your child. In 6 to 12 months USCIS willa approve it and that will allow your child to get a visa and come to the USA.Once in US,your chil will get a Green card and then later US citizenship.

Theoretically I believe you could bring your child on visitor visa, and then apply for N-600K, but there is no shortcut to immediately apply for a passport as the child does not automatically derive citizenship as he would if he was an LPR.
