Child born here

I got my card in July'04. We had a baby in May'06. Now I want to move to Canada to maintain my PR card.

I assume since my child is a US citizen she can freely enter and stay in Canada ? If i have to file for a PR card for her, how long would that take and what is the process...

What about her medical benifits ? Can I buy some private insurance for her. She will have to get her 6th month immunization shots in Canada.

Any help would be appreciated.

-- Not true. She can only enter Canada without a visa, as a visitor - for which the max period of allowed stay is 6 months.

-- If you landed in Canada before she was born, then you have to sponsor her for immigration - for which you have to live in Canada. You cannot just apply for her PR card as if it is your right (it is not).

If you landed after she was born and if she was not included in your immigration application, then your PR status is invalid. Because your family situation changed before you became a landed immigrant of Canada.

What about her medical benifits ? Can I buy some private insurance for her. She will have to get her 6th month immunization shots in Canada.

-- Asses your situation first, based on the two answers above and then think of her medical coverage in Canada. (Visitors can obtain private health coverage in Canada).

You say
"If you landed after she was born and if she was not included in your immigration application, then your PR status is invalid. Because your family situation changed before you became a landed immigrant of Canada."

What do you mean by that ? All 3 of us cannot land in Canada at the same time ? Me and my wife already landed for the first time in June'04 and got our cards in July'04. Since then i have been there 3 times of course only for a few days. Baby was born just 2 months ago. So now we all 3 land in Canada and then apply for her PR card my status will become invalid ?

Do you know of any private medical insurances in Canada. Does it work the same way as in US or is it different ?

This is what I mean:

Your baby was born in May and you and your wife landed for the PR in Canada in June. Clearly, when you applied for the PR, your daughter was not born. Also, when she was born, you were not a PR of Canada - officially - since you landed in June. Therefore, your family situation changed before you (officially) immigrated to Canada. What you should have done is this: you should have contacted the cdn embassy to notify this change in family (addition of your newborn) so that they could have included her name and sent you the new papers. Since you have not done that the status becomes invalid.

My question to you is: didn't they ask you about your baby when you landed? I am assuming that the baby was with you when you guys landed in Canada for your PR. If this is so, the question of baby's name not being on your papers should have come up.

Regarding the medical insurance: I know that you can buy the health insurance from Clarica (at least in Ontario). It is similar to what you get in the USA.

You are not getting my point...If you read my post carefully, and if your PR status is indeed invalid as per what I have told you, the question of getting your baby a PR card does not arise at all. (because you cannot get her a PR status in that case). Because you yourself are not a cdn PR. you need to reapply (I know, it's a pain). Contact CIC (or a good lawyer)...

njdude,

My previous post needs correction and u should have corrected me because I overlooked the birth year of your baby and the year you landed..

Now correct me if I am wrong:

You landed in 2004 and your baby was born in 2006, right? If this is so, you are safe. Your status is not invalid. Because you landed before she was born. All you have to do is to sponsor her for the cdn immigration. But for that, you have to start living in Canada.

Again, sorry for the confusion.....

np

But how do I go about doing this sponsoring. Right now im in the US. What forms do I need ? how much time does it take ? Is it worth it to hire an attorney to do it or is it a simple process ?

-- Go to cic.gc.ca and you will get all the info and the forms required for sponsoring. It is not tough and not worth hiring the lawyer. You can very well do it yourself. Since it is for a baby, it will not take much time..

But again, you have to move to Canada to sponsor the baby. Baby does not need a cdn visa, therefore, the baby can come with you to Canada. Once you are in Canada, file the sponsorship application immediately.
