I have a friend who has applied for employment based Green card
He is from India and the issue is that his child is 17 years 2 months

Does he qualify for expedited processing.

I think that if his child crosses 18 years this will terminate the processing for his child
Am I correct ?

Please assist

It depends on what stage of the process your friend is at. If he has applied for I-485 for himself and his child, the child is protected by Child Status Protection Act(CSPA) and the child will get green card when the parent's priority date becomes current and the child is unmarried.

If your friend is yet to submit I-485, then his priority date (PD) must become current before the child turns 21 as long as the child remains unmarried. Well, strictly speaking one must know all the fact to be able to decide if the the child will be protected under CSPA.

Expedited processing is applied by USCIS when the child approaches age 21 but again with CSPA I don't think anything will be done until the PD is current.

Thanks Guys for clarifying that Child cut off date is 21 years
