Of course
Sure, tons of chemists (I know of Ph.Ds only, universities and government labs) got approvals under EA, OR, and NIW. But I know a number denied, too: I watch the scene since 94 and the thresholds have been rising every year. This particularly applies to NIW (cases routinely granted back in 98 are commonly rejected now), but it looks the standards for EA have been going up too.
A few examples:
1. Research Associate at Ivy League school, Ph.D from another;
papers, patents, rec. letters as usual - NIW granted in 98
(would probably be denied today).
2. Similar to above - NIW granted in 98.
3. Similar to above - EA granted in 99.
4. Similar to above - OR granted in 97.
5. Professor at a Major University - EA granted in 00.
6. I work at a major Federal National Lab - a number of people
here were approved under EA and/or NIW, one was denied.
7. My own case has been submiited under EA in July, pending.
I\'m reasonably confident, but it\'s INS (and TSC).
