Mr Gotcher:

Can you please tell us how this "Mandamus writ" would work technically. Should the 485 file with the INS be older than a certain amount of time to pursue a Mandamus action against the INS. My file has been with the INS VCS since may 1999 with absolutely no input. I have come to a point where I am willing to try anything to get the iNS to act.

Not to be overly technical, but it is an action in the nature of mandamus, the writ was abolished about twenty five years ago. Essentially, what you need to show is that the INS is treating other people better than it is treating you. Since they have adjustment cases that were filed in late 1996, and they are approving cases filed in 2000, I think that you have a great case.
