When do you think the dates would retrogress for GC and how far would it go back for the EB2 category (initially and finally)? This will help me decide whether I should go for AOS or CP.
Attorney Murthy : Good questions. No one can guess that 100% correctly! Dept of State has said numbers may retrogress early next year and EB2 may go back about 1 or 2 years but EB3 could be 3 years or so. AOS will provide EAD, but choosing CP means the H1B has to be renewed if the dates go back.
Ms. Murthy, we applied I-485. How long does it take NSC to process I-485 on average? Thanks!
Attorney Murthy : Most Service Centers are taking between 1 year and up to 3 years to process the I-485 assuming dates stay current. If the dates retrogress, then the INS cannot approve the case until the PDs become current again for that category for that country.
