Changing Jobs - any advise/info would be appreciated

I have filed my I485 end of 2002. I140 is already approved. NO FP yet. I have a good possibility to change jobs. New employer is in another state. Position is higher/different than that of LC. Salary is 30-40% higher. Work done would be in the exact same industry and similar to that described in LC.

Is it possible for me to accept this offer ? Will there be any problem with GC ?

I am tired of waiting for the GC and do not want to miss this opportunity, if possible.

Any advise/info regarding this matter would be very much appreciated. Please respond.

Thank you.

Just go ahead and accept the job if you like it. There is nothing worse than working for a JUNK company. Say no to GC slavary. Get an employment latter from the ermployer with the job description + salary and contact a lawyer. Good luck !

It has been so long since the last time I red the official Memorandum regarding the AC21, but if I am not mistaken your I-140 must be aproved and still you have to complete at least 180 days (after I-140 approval) with your current employer.

Also the memo says that the new employment must be same or similar, but there is no rules to define "similar". Regarding the salary, more is better.

Get a copy of the original AC21 memorandum and if you want hire a experienced lawyer to review and compare the old and new position description and give you his advise.

As soon as you change your adress you MUST inform USCIS; you may want to use a lawyer for this as well.

God may bless you!

Question to Tombaan,

For AC21, Is it 180 days after 485 receipt date or after 140 approval date?

Thanks

AC21 rule

Since tombaan is busy enjoying his GC :D then I will respond ...

The 180 days are from the date of receipt of your I-485 application providing your I-140 has been approved already.

I am attaching a copy of the Memorandum so you can read it by yourself.

I might sound naive, but i guess i am really, when it comes to immigration matters.

I have a few questions, inspite of reading many posts, either it must be too much information or it must be very early in the morning here.

Anyway,

My I-140 was approved Sep'04.
I-140 and I-485 filed Dec '04.
Recieved AP around Jan '05.
Recieved FP on Mar '05.

I believe my case was filed at the Texas INS center.

I want to know, when i can expect to clear the I-485.

And in case i want to switch my job after 180 days of I-485 pending, is it necessary to do that using a lawyer and what documents do i need to do so ?

Thanks,
Ravi.
