Changing Jobs after 180 days if your an ***EB1***

Guys,

I\'ve seen lots of people in EB2,EB3 category change jobs
after 180 days and successfully get their GC.

The requirement seems to be to make sure new job has same title as in
labor certificate and new wage is not lower.

However, this doesn\'t apply to EB1\'s as there is *no* labor certificate
(this first stage is bypassed).

Have any EB1\'s sucessfully changed jobs after 180 days and gotten
their green cards?

In particular have people gone from High Tech work to Academic
positions? This is a strange situation as the salary\'s are almost
halved, but you only have to work a 9 month year in academia

There was a lot of discussion about this in isn.org some weeks back - prompted by an opinion by one of the prominent attorneys (Ron Gotcher) who said that those who applied for 485 based on their L1\'s, without Labor certification could not benefit from the 180-day rule. As I remember, there was no conclusive end to that debate, with opinions still divided on the issue - the only way we will really know is when someone tests the provision and successfully gets 485 approval after changing jobs from the L1/EB1 position.

Doesn\'t mention anything precluding non Labor Certificate I485
petitions.

I don\'t understand his arguement why non-LC I140\'s are
not portable.
 
did anyone do FP at a non-designated ASC

Hi, All:

    I have a question from an old man. He applied family-based GC (his son is a US citizen), and after receiving FP notice, he did FP twice at San Franciso, but failed both times because of unsatisfactory prints. Now he has come to New York to live with his daughter. Can he do his FP in New York or he has to fly back to SF?
