Changing Job During I 485

I AM WORKING WITH THIS CLIENT SINCE 1995. MY CONSULTING COPNAY HAVE FILED MY GREEN CARD. PD MAY 1996, I-485 RD JAN 5 2000 ND JAN 25 2000. NO AP RECEIVED YET. STILL WAITING

MY CLINET WANTS TO HIRE ME AND WITH GOOD SALARY. I HAVE EAD NOW AND CAN RENEW. IF I LEAVE MY CONSULTING COMPNAY AND JOIN MY CLIENT COMPNAY WILL THERE BE ANY PROBLEM WHEN I GET MY 485 INTERVIEW CALL. I HAVE TALKED TO MY LAWYER AND OTHERS ACCORDING TO THEM AS LONG AS YOU ARE DOING SAME OR SIMILLAR TYPE OF JOB NO PROBLEM IN 485 AND I DO NOT HAVE FILE 1-140 ON NEW COMPANY NAME.

ANY ONE HAVE DONE THIS OR AWARE OF CASES LIKE THIS PLS ADVISE

How do you renew your EAD . If you EAD becomes invalid before you go for the interview how do you renew it. Do you have to have the employer who sponsored your Green Card do something?

I don\'t think you need any employer information to file EAD renwal. I have checked the details for I-765 and it does not ask for anything regarding your employer.

I am sure you will be questioned when you go for the I-485 interview but according to lawyer it is OK to work in same field and change jobs. I have not expreince 485 interview.

Does any one had situation like this and if yes pls share info

There was a posting about some address curi or soemthing who had gone for the interview after changing jobs. Looks like no problem. Even my lawyer said the same. My lawyer\'s words were
"The final regulations have not come down from the INS yet in regard to how the new law that was passed will affect the Green Card process, but it is their intepretation that the piece involving changing employers while in step I-485 step is this: employees may change employers after their I-485 has been filed for six months and that they are staying within the same job category (or industry). Employees do not need to notify INS that they have changed employers, as long as their home address has stayed the same."

There have been some warnings on this board about not changing jobs as yet, despite the 6 month clause of being able to change jobs in the field after I-485 filing. Apparently, the recommendation is to wait till the INS releases it\'s ruling. However, the law is rather clear that change of jobs within the same company, and to another company in the same field is allowed. I presume the INS can\'t screw around with that. So, if you filed in January, it\'ll most probably take another 6-8 months before you get the I-485 approved, by which time, the proper rules should be out. And you won\'t be affected.

So, you might as well switch jobs. Another thing you might want to do is have the new company apply for an RIR based I-140 for you - a new one. Then when you go for the AOS, you can simply apply the new I-140 to the AOS - this was being allowed even before the recent law changes. So, you shouldn\'t have any trouble eitherways.

GO ahead and change jobs dude!
