I am currently residing and working in the US
I had an L1B visa through my company. It was scheduled to expire July 2005. My company is going to assist me in my application for a green card. However due to the lack of time on my L1B, they have successfully applied for an H1B visa for me. I have the I797 petition and acceptance forms back for my H1B.
My HR manager tells me she has to reverify my I9 form by October 1st 2004. In order to do this she needs my restamped I94 card. It is my understanding that I cannot get this until I leave the country (go back to England) visit the US Consulate and get my new visa issued and stamped etc. Then when I reenter the US I will get my I94. Correct?
My issue is this. my new H1B visa has a valid on date of 10/1/2004. Does this mean that I will be unable to get this visa stamped /activated etc in the UK until 10/1, or can I plan a trip now to get everything I need?
Any advice would be much appreciated.
