Changing from CP to I485

Hello All,

I had requested for CP during my I140. My I140 got approved in September. Then I changed my mind and went for I485 and applied for it using the I140 approval notice last week.

Now my file lies with NVC . How should I get the file back to INS, Vermont? I would imagine that INS would require my file for processing my 485. Is this going to delay my getting receipt of my 485.

In the mean time I got a choice of agent and address form from NVC with four otions: 1) I appoint, so and so as my agent 2) I don't appoint an agent and my mailing address is so and so.3)I have already legally immigrated to US and don't need to apply for an immigrant visa. 4) I no longer wish to apply for an immigrant visa. Now that I want to go for CP, which option should I select? There is no option stating that I would like to go for I485? How would I let NVC know that.

Thank you so much for you time,

Regards,

Subh

Hello,

I was in a similar situation.
I changed my options after responding the confirmation letter selecting CP there.
I don't think you need to tell NVC that you changed your mind.
My lawyer received P3 and keeps it at his office.

But please consult your lawyer about this. I can't garantee anything.

I didn't see any delay except I needed a time to take medicals and prepare for other documents to file I-485. I received receipt notice and FP notice within a month. This was filed at NSC.

hope this helps.

I was in the same situation. I am doing 485 now. No delays so far at least, nothing related to the CP approval.
You can call them(NVC) and ask them if you need to take a specific step. They are very friendly and very helpful. But otherwise, they wont proceed unless you send them the P3. You might even get a letter from them saying that they noticed that you have a US address and thus might be eligible to file for AOS(485). You can then respond to that letter.

Best luck with your 485.
