Changing employers & working on H1 w/ 485 pending

Hello All:

I would appreciate any responses from you gurus regarding the following situation:

- I have received my AP and EAD and am currently working on an H1 (expires in 2010) w/ Company A. I am about to get an offer for employment from Company B in another city. Also, I plan to marry by the end of this year. My question is: Can I get employment w/ Company B on an H1 visa transfer? If so, does this impact my pending 485 application and how?

I could start working for Company B using my EAD/AP and loose my H1 status. But my marriage at the end of the year prevents me from doing this - I would need to sponsor my fiancee for an H4 visa and therefore don't want to loose my H1 status.

H-1B has no bearing on I485 in your case. You may ask the new employer to file for transfer of h1-B before you join them. Once h-1b transfer is approved, you may move to join the other company. Ensure that if you want to invoke AC21, its been 180 days since 485 was filed before you switch over and at the time 485 is adjudicated, your job profile matches (by > 50%) to whats mentioned on your labor approval.
