Please help me. I am currently on 7th year extension. My Labor was filed 14 months ago and I am planning to change employers (joining Company B) as my current employer (Company A) is facing hard times and not able to show income sufficiency. Lot of queries are coming from INS for our petitions and no approvals. My questions are:
1. Can I change employer with 7th year H1 extension based on Labor filed by previous employer (Company A)?
2. What happens if Company A withdraws the Labor petition (or goes bankrupt)?
3. If Company B files for Labor immediately (say paperwork takes 1 month) and I need to go in for 8th year H1 extension, it will still be based on previous employers Labor petition (as Company B petition will not complete 1 year)?
I have checked with Company B for pre approved labor but they dont have any matching my skills. They are a bigger company and can easily show financial solvency.
Please help me out.
