Am working at this company since July 2000.
Labor approved on 19 March 2003. After that, applied for I485, I140, EAD and AP.
I140 got approved on June 16, 2003. Means its approved more than a year ago.
I485 Notice date is sometime in May/June 2003. Gor first FP done in March 2004.
Now, I have a great opportunity to take another job, for which I think I am eligible through the portability rule.
Is there any way in which the current employer can screw it up? Can they cancel the I140 and as a result make me ineligible for I485 approval when the time comes.
Or is it that since I140 approval is more than 1 year ago, now they cannot do anything with the I140.
Would it be safe to switch the job under AC21?
