Changing employers during GC process

Hello Gurus,
Like most of us…my case is also sponsored by a company (A), after 7 months I got been laid off by company (A) and agreed to help me to continue the entire process…I found another company (B) and joined with them … during this period my labor was cleared and applied I-140/I485 concurrently, company (A) helped and stated in the letter once I get the GC he will provide the employment…I guess now it is a future employment case. Got EAD and all and I worked for 15 months for company (B)….For a valid reason I left company (B) and joined company (C) on EAD… I did not inform USCIS regarding this….I got I-140 RFE regarding employer financial eligibility to pay. Company (A) provided the letter and then got the I-140 approval….Now I am waiting for I-485 approval….

My question and concern is once I get approved, if company (A) does not have a job for me (most likely it is the case) ….What should I do? Please give the best bet that will not jeopardize the future Citizenship process….will appreciate your input.

First thing is I smell an RFE/Transfer to local center for your I-485. I know you are not going to like my reply but what I am saying is through experience. If you see the "Transfer to Local Offices - Atlanta" thread you will know why I am saying that. Lot of cases of future employment have recently been transferred to local offices.

If you think your job in Company "C" is stable enough, then I would suggest if you get RFE/Transfer you use AC-21, then you will have commitment only to work with them which you are already doing. For some reason if you get a straight approval then I would recommend that you work for the sponsoring employer for some amount of time (It will be best if you join them right away after approval), otherwise you will definitely have questions at the time of Citizenship and your intent of getting the GC will be questioned and I don't know what is the right answer to that.

Other thing I can think is that if you have more than 6 months with a pending I-485 then I would suggest that you file AC-21 now if you think your job is stable enough and you can survive there for atleast an year after applying for AC-21. That way you may be able to avoid the RFE/Transfer and get a straight approval.

To conclude, we can plan to whatever level in the end it's all matter of luck.
 
What kind of RFE

Hi PremChopra,

What kind of RFE I can expect if at all comes?? Can I be have some time to think and act at the time replying RFE or Transfered to local office....I don't have any gurrantee that I can stay with Company C....So that is why I can't use AC21....will appreciate input from fellow members...
