Changing employers after 11 months

Hi,

I applied for my I-485 from VSC with the ND being Nov 15 2001 thru company A, and I have been working for a client which is company B. Now Company B has offered me a job with a higher salary and want me to join immediately. Company A is also ok with it. I have spoken to the Company B lawyer and they said that they will try to match the job definiton to almost exactly the same as my job definition on the LC with Company A. I am still nervous as to whether I should take up this offer or not, since I don't have to end up in any problems with the I-485 approval, just because of this job change. Has anybody, or does anybody know people ,who have changed jobs ( not because of being layed off..but just because they wanted to join another company...) and have been approved/rejected.....and what have been their experiences ??

Im in your same situation, I been working with the same company since jan 2000, we file my I-485 on feb. this year I receive a very good offer from another company, with better salary and they are going to match job description and title, does anyone have a trouble after that?? I call my lawyer a couple times already but haven't call back, Im getting nervous about it, any comments are very appreciate.

AC21 485 portability should be applicable to both cases. Since INS has not adjudicated the case for more than 6 months you guys can switch to new job, as long as the job is of similar description (higher salary doesnt weaken your case), and you can produce letter from old company that you worked for more than 6 months following 485 application and pay stubs and employment letter from the new company you should be ok, even if there is an RFE.

I heard both views about informing INS. My understanding is even if you dont, it is ok. If you have the new company lawyer file an application for change in representation (of attorney) and change in employment, it might save you from RFE. But even if RFE is issued or Interview is required, as long as you have the required documentation, you should be ok.
