I am considering to apply with another company. I am in my 8th year of my H1B that will go until next June. My LC has been filed in '04, the 45-DL has been received and answered. However, my LC has only been pending for 800+ days now, and I hear the average is around 1350, and the maximum up to 2000 days and more.
My employer knows I am unhappy where I am, but does not want me to leave. Last year my extension was purposely drawn out and the notice delayed so that I would not have 365 days on the H1 once I have it in hands.
I expect them to pull every trigger they can once I would give them notice.
They don't give my my case number, they do not give me an voluntary information, only if I ask. I was told from the lawyer once that I am not their client, my company is.
I have 9 months left on my H1. If I find a new employer, I might have a PERM approval in 6 months and before the H1 expires.
Besides losing my priority date, would a PERM approval alone allow me to stay in the US past the H1-expiration?
Assuming my current employer will just be a [#@!#] and try everything to make my change impossible, would a withdrawal of my LCA affect the current H1?
