I am currently in my 6th year of h1B- 8 months remaining on my 797, and have 140 approved. I-485 not yet filed because of retrogression.
So if I change employer now, would the new H1B be granted for 3 years (based on prior approved 140) or only for 8 months?
Would appreciate your reply.

Thanks

What will hurt you if you request 3 years increment but the USCIS just grants one year increment?

Immiq:
If USCIS grants only one year on my transferred H1B, what'd be my options for extending the H1B after that one year elapses?
(It may take 3-4 months for the new company to file PERM, so I won't have 365 days of pending labor by the time my H1B expires).
Would I be able to extend using the old employer's 140?
Would appreciate your reply.

Thanks

Don’t you have an LC filed one year ago? However you will have to consider whether your old employer will withdraw your I-140 and LC. There is a potential risk. Or, you can try premium processing for 3 years increment and only say goodbye to your old employer after you get an approval of your H-1B transfer.
