Changing employer and having a different lawyer

Hello All,

I have been with company ABC for the past 5 years, and I applied for my GC process through them. My I-140 and I-485 were applied in Jan 2003. My I-140 was approved 3 months later.

I have paid for all the processing for my GC myself. I have a good relationship with my employer.

I am using my EAD since October 1st 2004. I am changing my employer now.

1. My Lawyer is charging me $1000 for me and my wife to notify INS about my employer change via AC-21.
2. My new employer is providing me the same services through their lawyer, with no fees.

Is it alright to let the new lawyer notify INS of employer change for me. If so, can my previous lawyer still represent me.

The reason I am asking this question is my previous lawyer was charging me $1500 to renew my H1B visa, and I feel he is all out to make money from me.

Please advise if I can use my new employers lawyer to represent me and is it ok for him to continue to represent me until the I-485 approval. My only concern was, the impression that would be created if two lawyers represented me at different times. (Until now, and From now on.)
I would appreciate any comments on this matter.

You can use your new lawyer to represent from now on and make sure that you fill out G28 form and send it along with Ac21 papers.

ps: $1000 for Ac21 is quite a bit and you can send the papers by your self but since your new employer's lawyer is not charging any money that should be fine.
 
Can I send notify USCIS of the Employment change myself

Hello,

I would like to know, if I can notify USCIS of the employment change myself, and continue to let my existing lawyer represent me. I guess there is nothing more my existing or new lawyer has to do at this stage, unless I get an RFE.

Please note that, I applied for my advance parole and EAD through my lawyer the first time, later I applied for them online myself and replied to RFE and got approvals. So, the lawyer is representing me, but I am also kind of representing a few of my cases.

Can I notify USICS of my employment change ?

Any answers would be appreciated.

yes you can notify CIS by yourself.. but you need an EVL letter with same/similar job title and duties (same as LC especially job duties)from new Employer.

First of all, thanks for the reply.

I do have the employment letter from my new employer and the designation is the same, and the salary is well over what was in the LC.

I guess, I can go ahead and notify USCIS about my employment change. Another quick question, my wife doesn't work, do I need to notify USCIS, about her case, since she is my dependent.

Also can you direct me to the documents needed and the formats ?

My I-485 got approved

Everyone and hmd,

I checked my status and saw that my I-485 was approved yesterday. I am waiting for my wife's approval, I guess it is just a matter of time.
