Hi Folks

Case details:

Does changing employer after 180 days of I-485 notice date and also to a new address which falls in different BCIS judistriction causes transfer of the pending I-485 case ?

I-140/I-485 filed concurrently at VSC and I-140 approved for EB3

Please advise ..

Moving on pending I485

So, if I140 approved and 180 days passed and you move to different job and location in somewhere in the country which comes under different judistrction of BCIS service center, the I-485 still being processed at the service center (VSC) where it was originally filed ?

Was filing AR-11 for change of address will not invoke transfering the pending 485 to the local office or service center wher your new address is comes under?

bottom line is, can one still gets processed his I485 at the service center (vsc) where he originally filed even if he moved to a new job(similar in LC) at different location (texas) after 180 days with an approved I140?

Gurus and experts in the forum please advise...

There is a chance of getting an interview, in which case it will be transfered to your LOCAL (new location) BCIS office.

It is not just a chance for the transfer. With a change of employer you lose the interview waiver that is granted to all EB applicants that have the same employers for the whole I-485 processing. The only way to escape the interview is to pray that you don't get an RFE and the BCIS never finds out that you changed employers.

BCIS based on history knows that a lot of people have consulting jobs which involve moving to different places based on the projects. There is no correlation as far as I know between change of address and an RFE or a transfer.

Some people don't do an address change by giving their friend's address to the BCIS. This in my view is risky because you need to show the driver's license or in rare cases a utility bill to prove your address.

When I was filing for my 485 I had to decide between TSC and VSC because my labor & 140 were approved from VSC and we stay in the TSC jurisdiction. I talked to Rajiv Khanna and other experts in this forum and I got the answer that I can apply at either TSC or VSC. Since VSC is better, I applied there. I got an RFE which I think is random and I don't know if I will get a transfer.
