Changing 485 to CP

Hi all,

My husband's 485 was filed in October 2002 at the California Service Center along with his 140 application, using a LC approved for an ex-employee in the same position.

At that time the lawyer advised us to take advantage of the concurrent filing instead of going for Consular Processing. But given the current speed of processing at CSC it doesn't look like we will get our greencard for another 2-3 years.

I was wondering if anyone had changed from 485 to CP and how fast the ammendment was approved by INS and where to file it.. i.e in our case do we have to file at 485. Also on Immihelp.com it says that you can change from 485 to CP by submitted an Attorney Certified I 140 directly to the consulate without filing for an ammendment with INS. Did anyone follow this path. How safe is it?

You can do the AC140..

at Mumbai and Delhi only. Chennai has not been accepting AC140s. There have been instances where people have filed AC140s at Mumbai without I824 notices successfully. You will have to search the forum for details. If you are under chennai jurisdiction, you have to apply for and get I824 approved and then proceed with CP. Discuss with your attorney and research this forum. Good luck.;)
 
THe chennai US consulate website says, they accept AC140. Rajiv, do you know of any AC140 case at chennai being rejected. If yes please post.

To this day I have not heard of a single case of AC-140 being accepted by Chennai Consulate. It is done on a discretionary basis by other consulates but now that almost ALL non-immigrant visa applicants require interviews, I don't think other consulates will continue to accept it any more because of the added workload.
