I changed jobs while I485 pending, I have read here and most people recommend to send a letter to uscis to inform them, however my attorney insists on waiting for the RFE. The attorney has been very competent so far, he authored some books and was president of the local chapter for AILA, unfortunately he doesnt explain things very well to me.

Anybody has any idea why he rather wait for an RFE than sending a letter to uscis informing them that we plan to use AC21?

I waited for RFE and submitted AC21 letter as part of RFE response. I enquired with murty.com and my attorney and both said wait for RFE.

But some gurus in this forum suggested that send AC21 so that you won't get RFE there by saving 5 to 6 months

You need to decide by following your gut feeling.

My attorney gave me a choice -- they said even if you send the letter, you will get the RFE. So you might as well wait. Which is what I did.

However I got a NOID recently (30 days response time) and it made things a little difficult. On hind sight I think I should have sent the letter i advance. Just my 2 cents.

can you clarify?

would you mind sharing with us the details of your case?
Why did you got a NOID? How did you handle that.

Thanks

It was general understanding that you can change the job any time after six months and before approval it should not matter whether you informed BCIS or not.
But recently One of the 'top' law firm gave the advice that green card is not usable since he did not inform the BCIS before the approval about change of intent.
Even then that person went ahead and got it stamped.

If you do not get an RFE again you will be in this grey area until 5 years or 10 years.

not usable???

if i change employer from company A to cmpany B and not inform uscis, and 140 gets approved, but company A shuts down...while i am working in company B (still 485 pending)....have same title, job desc, geog location etc...do i have to inform bcis?

can i wait for rfe? if i get my gc approved is it valid?
