Changed job.. Got RFE.. Response to RFE....Help please

This was one of the old discussion topic I chose. Apparently I don\'t find those people on te board now who particiapted then... everyone must have got approval.

Responding to RFE with Sponsoring employment letter, current paystubs and W2.

I was going thru\' the exact RFE yesterday, noticed neglegence on my part, it\'s asking for Current Employer\'s letter!
Earlier, I thought GC is for future job and hence got employment letter from Sponsoring employer stating that they will hire me after approval of my GC with salary ad duties mentioned in the I140 application.
Now I don\'t know whether to give both current employer letter and Sponsoring emplyment letter or either one of them.

Immigration Gurus, myladoor, bhanu, tomhanx, ukt and others....I\'m cofused please help.

I am sorry I am not too knowledgeble in this aspect but I shall express my opinions. I think you should include current employers letter. In addition, you may also submit an employment letter (offering job or returning to) from Sponsoring employment letter as an addendum. This way you have the records straight with them. However, please consult a lawyer to come up with best solution. I would suggest a second opinion with a totally independent lawyer who you know is good.

Hope this gives you a sense of direction.

I\'ll definitely consult another laywer before proceeding.
The problem in submitting 2 letters is... The salary stated as per I140 in my spoonsoring employer differs 40K from current emplyment is providing. I can ask current employer to lower my salary figure as per I140, but INS will come to know about my current salary from paystubs and W2.
The thing is does INS believe I go to work for my Sponsoring employer, if I provide 2 letters one from current and another one from supposed to be future employer with salary offer less than 40K from Current job offer? It might definitely be of some concern.

Also, I may not be eligible to use 180 day rule as I had to leave my sponsoring employer after 90 days from RD.
Possibly I might stick with sending Sponsering employment letter , current paystubs and W2.

hi! I replied to your original post too. well - I would say the same - give both the employment letters - current one
and sponsoring one. The 180 day rule says that you can change jobs but in the same employment category..
like if you applied for GC as a computer programmer, after 180 days you cant go off and work as say a sales agent..
so this might be to make sure that you are still employable in US in the same field you applied for GC (which is in my
original post too). Nothing more to worry about bcos of this... consult a lawyer!

Thank you very much for your response and moral support.
I talked to my attorney about "Current Employment letter" after lengthy dicussion he said it\'s OK to give both Sponsoring employer letter (Full detailed offer letter) and short Current employment verification letter saying so and so person is working in our company from so and so date using INS EAD# valid from so and so date without giving the details of salary, duites and all.
I felt happy because it satisfies the RFE literally by giving current emplyment info.
Consulted another famous attorney for 2nd opinion, he said "Only Sponsoring employer letter" is enough which put me in dilemma again.

Anyway I have both letters now, I\'ll keep posted.
