Change to CP - applied in OCT

Does any know if its possible to change to CP after applying I-140. My lawer sent the package on Oct 10th. Does any one know if its possible to change it to CP before the I-140 processing completes...what is the procedure...

Yes possible

Yes, it\'s possible, and I know that someone has done that. You can ask your lawyer to write a letter to INS to ask them to change it. (do a follow up 2 weeks later to make sure that). I have seen posting that people has done that.

Another way would be to file for Consular Processing with AC140 after your I-140 approved. But that depends on your consulate to see if they accept AC140. But AC140 requires the receipt of I-824.

The easiest way is to ask your lawyer to write a letter with your EAC number to the INS.

If you wait after your I-140 approval, you will have to file I-824 which can cause a long delay.
