I know this has been asked already (about changing status after being layed off), but I was trying to get the latest news on this. I was layed off this Friday (05/09), my wife is on H1 status, so I need to change status to H4 ASAP. This I know...
Now, everybody says that I am out of status as soon as I am unemployed, which is already 2 days a go... What's INS (well, BCIS) position on this? Are they so strict? I didn't have any clue I will be layed off, how could I file BEFORE my status expired?
Also, should I worry and get all the documents in order and send them today, or is it fine if I wait until Wednesday (my previous company is paying a consultation with the attorneys, but that's scheduled for Wednesday)?
Can someboby point me to the documents I need? Does my wife has to file anything, or is it just for me I need to file?
Any help greatly appreciated.
Thanks
Cristian
