Hello,

I was hoping if someone could help answer my questions. My uncle, who is a US Citizen, filed for my parents (his brother, sister in-law) back in 1992. Their processing date is Oct. 1994. The process is now at a point where the paperwork has begun, as far as providing affidavite of support and other required documents. Currently, the processing time for category 4 visa is March 22, 1994. Therefore, we are expecting my parents to come to the United States in about a year.

However, the problem is that my uncles wife no longer wants my parents to come over here. She does not want my uncle to go through the remaining process. I am currently in the US and am married to a US Citizen. I was wondering if my uncle could transfer the application process to my name instead. Is this even possible? If so, what would I have to do? Also, does it impact the timelines?

If the answer is no to the above questions, that my uncle can't simply transfer the whole file over to my name, how can I bring my parents and my brother (15 years old) to US - I am expecting to become a US Citizen in August of this year - should I wait until then and file? How long is the process?

Finally, I have heard from some people that if you are a US Citizen, you can bring your parents to the US in 3 months by applying through the US embassy in New Delhi, India. Is this true? If so, can I also file for my brother the same way?

Okay, there is no such thing as "transfer" of responsabilities neither sponsorship. See your uncle is the one who applied for them because he is a US citizen and could apply for siblings (plus this is the first to file first to serve within the category and country)and he is the one who must continue it if you want your parents to come now and follow the process that they have been waiting for years. If your uncle doesn't follow the process he will have to withdraw the petition and all these years of waiting have been in vain and they won't be able to come anytime soon or until you become a US citizen.

To put the "transfer" explanation in better way is like your wife has license to fly an airplane (authorize pilot) but she doesn't feel good so she ask you to fly for her. You can't do it or you wait until became a pilot ... Kind of like that :)

If you become a US citizen you will be able to apply for your parents. The timeline can be from 6-12 months. As a US citizen you will be able to apply for your brother, but the waiting period is around 10-12 years right now.

The only people who doesn't have a waiting period or better say that don't have to wait for a visa number to be available are the immediate relatives of US citizens (spouses, parents and unmarried children under 21). The rest must wait for a visa number to become available (check the Visa Bulletin at the Department of State website for dates) at the category that they will be.
