Change of Waiver Job

Hi All,
My wife is currently working in a J-1 waiver job at the other end of the country. If we are to find her a waiver job in the area I work, does she have to go through the waiver process again to be employed? The previous interested government agency was USDA and the new one will not be USDA. She is currently on H-1B and completed about 1.5 yrs at the present waiver job. Will her 1.5 yrs service in the HPSA count towards her proposed new waiver job requirement? Thank you very much in advance for your input.

Yes, she may change

She doesn\'t need a new waiver. Her 1.5 yrs already spent in HPSA will count towards her waiver years (whether NIW or otherwise).

u will have to come up with a justified reason to change job (e.g *Relocation* as the reason for changing the job).
if waiver was obtained th\' state 20 program then u needed permission from state dept of health for switching. Ur wife\'s waiver was th\' USDA and they have closed office. So I am not sure who will be granting the permission for switching (whether State dept of health in her current job or in the new job OR the DOS)

i guess, u will have to call the State dept of health and/or DOS to find out.

ps: if u find out, post ur results here, so others may benefit.

No Title

you will need to apply directly to INS for a new H-1b (for the new location) explaining the extenuating circumstances prompting the job change. you do NOT need to involve either USDA or state dept of health.

I relocated while doing j-1 waiver but my relocation was prompted by my employer shutting down and cooperating with me to find a new job in the same state and writing a letter to INS explaining the circumstances. i included this letter with my H-1B petition for the new employer

i am almost 100 % sure that the fact that you two live separately is not a sufficient reason for INS to allow a location change but you can try

Thank you very much.

Hi SudhirS and J1victim,
Thank you very much for your response. I wonder how the IGA keeps track of the waivers they issued and if the area is still underserved or not if people just deal with INS and move from one MUA to the other. Thanks again.
