Change of Status.

Hi all,

I have a friend who is going to get married in the next couple of months. He is a Citizen and the spouse to be is currently on OPT expecting her H1 before they get married. They want to go to India and get married there. Now there are 2 scenario's that we see possible.

Scenario 1:
H1 for the spouse gets approved. Does she go to India or Canada for stamping? When they do get married, should they file something in India or come back on their "before marriage status" and then file something here?

Scenario 2:
H1 is not approved. She goes back to India, and then they get married. Now should they go for DCF or should they go with K1 Visas?

Any input is greatly appreciated.

I have a little update on this issue. I have confirmation that H1 is approved, so the question now is should they go to India get married come back on H1 visa and Citizenship and then file for change of status? Is that going to cause any issues at all?
