I am posting this for a friend who is in limbo right now. She was on F1 and her F1 Visa was stamped Valid till July 2005. She had been working on CPT for the past few months. Her employer filed for her H1 and the H1 was approved in early July.
Apparently on the same day her H1 was approved, her F1 was revoked. Is INS revoking existing Visas if a new Visa is approved for that person?
But the interesting thing is her H1 will come into effect only from Oct 1. In light of this, why did the INS revoke her F1 in July?? Should she contest this revocation with the INS.
An important point is that :because her F1 is revoked, she cannot even legally work right now (because CPT derives from her F1 status).
Is there any way to be able to continue to work till Oct 1 in CPT and then from Oct 1 on H1?
