change of status (H1B to F1) and tution

Hello,

I was laid off from Sun Microsystems from Nov 1, 2001. SUN attorney informed me to get H1B on file before Dec 28, 2001. I was not able to find any promising job so talked to friends and they suggested to join school.

I approached Elgin Community College(ECC) in Illinois(IL) and told them about my situation and they agreed to have me register for Associate degree course (4 years) and have got me I20 which I have send to INS (and have their acknowledgement receipt).

I also learned recently from my friend that ECC which has charged me international student fee is wrong. I have been in IL for more than year on H1B visa (while green card was in process) so I am eligible for instate fee. I approached ECC around Dec 15, 2001.

I am charged about $4000 as international student fee (per semester for 12 credits) while as per my friend he says I should be paying about 1/3rd of it. could you please verify so I could save money.

No matter how long you stay in IL, as long as you cannot prove yourself to be either GC holder or US citizen you need to pay out-of-state tuition.
I\'d been fought for this for my entire college years and still could not change this.

Schools measure "Intent to form Domicile" while classifying students as in-state or otherwise. If you have h visa (dual intent of forming domicile in US and returning back to India) and if you have been in that State for 1 yr, you can get urself classified as in-state student with appropriate evidence. Since you switched from H1B to F1, you are not eligible anymore because F1 is a single intent VISA (i.e. Going back to Home country after schooling)... Be aware that many states are trying to change some interpretations of laws or laws, to reclassify all H Visa holders to out-state students even though they have stayed in the state for x>1 number of yrs.....

In texas H-1, H-4 students are allowed to pay instate if they can show one year Texas residency. Since you will converting back to F-1 you will not qualify for this Instate tution. However this criteria may be different for other states.
