I will highly appreciate if anyone can help me to confirm the following question.
My brother came in USA under J1 visa. However, the company which issues him the visa broke the contract with him and left him in the middle of the road. I then took him to a private school where they tried to apply for a change in visa status for him to F1 since October, 2006. However, on May, 2007, we got a final decision of denial because they said his J1 is terminated since october, 2006 (without our knowledgement) and IRS request him to leave the country immedately.
My question is will the fact that you get rejected for a change in visa status, be counted as one time of having the visa application rejected.
