My husband's I20 is expiring on July 31st '07 and since he is a student in Kaplan, he cannot apply for OPT. He is hoping to get a J1 or H1 in July '08. And he needs to maintain his status until that time. I`m an F1 and my I20 is valid until December '08. We got married this June hoping he would apply for a change of status to F2.
But now he is worried if his application of changing status would be denied since he entered with an F1 for MPH program and then switched to Kaplan's USMLE program. We tried to describe the reason of changing schools ( he was a Katrina-evacuee). However, he is worried b/c he thinks the USCIS officers might think that his intent is to work as he has taken the USMLE courses. (The I 20 says clinical and medical studies and it doesn't mention if he took the exams though)
Which one would be a better option ?
1) Applying for a change of status to F2?
or
2) getting an I20 from a english learning academy and stay F1 until he gets to apply for J1 or H1-adjustment of status once he gets into residency next year (July 08) ?
