I am working for an employer 'A' and this employer 'A' instead of filing for GC, they gave me pre approved labour(PD: 6/2001) in 2005 Jan. I have applied for I-140/I485 on May 2005. My I-140 was approved on Aug 2005 and I got the EAD and I did go to finger prints. But Still I am in H1B visa.
Now my client wants to hire me. As it is a pre-approved labour it it going to be a problem?.
Can I join the client with H1B or EAD?
Is it possible for my client to process for my greencard (not from the starting...from where i left with my previous employer?)
I will be thankful for your suggestions

USCIS is closely scrutinizing substitute labor. I believe they have a rule making process whereby they are going to soon abolist labor sustitution as a whole. IMHO labor substituion is a tricky nowdays. ...orginal labor is much better and has a much higher chance of approval
 
labor sub can be done .there is no law in effect.if your case is solid with all paper work CIS cannot deny !!! Think about it :) why worry if you have all paperwork ..all you are doing is using a pre approved labor which would otherwise go to waste
