Change of Job, Preserve PD?

Hi,

I am currently pursuing a J1 waiver as an internist. If I change my job at the end of the waiver and pursue a job as a specialist, can I preserve my original PD, based on Labor Cert or do I have to file for PERM again as an internist?

Thanks.

i was told that the PD is transferable as long as you are applying for a similar job under the same EB category. however, the new employer will have to do a new PERM and I-140 (but the original PD date remains)

Thanks psychmd7. That would unfortunately mean that if I complete the waiver as an internist, including labor cert, I would not be able to preserve my PD if I pursue a subsequent job as a specialist.

Will update the forum as necessary. Would appreciate if anyone had to deal with this situation could throw some more light on this subject.

i am sure that can be worked around. it depends on what you listed as your job description and to keep it as close to that as possible. only an attorney will be able to tell you exactly if it will qualify depending on the job.

Yes, I did talk to an attorney and she felt that transferring the PD can be done. Of course the hassle of refiling LC and I-140 remain.

Priority date ofEB2 category to be used for labor cert I-140

dear freinds I have the following situation please giveme your sincere advise.

I am a physician, and I concurrently file my I-140 through NIW, I-485, and also EAD. Every thing is approval state, except that my 5 years of medical service in underserved area is going to be finished on August 31/ 2008. At the same time I have my I-140 through Labor Certification approved with priority date of June, 2006, but the priority date of my NIW is August, 1, 2003. As per current visa bulletin the priority date has moved to April 2004 for EB-2 from India and hence now I am confused whether I should I request USCIS for the priority date condition or they are going to send me interview for I-485. Please let me know if there is ANYBODY HAS SIMILAR SITUATION or any qualified viewer please help me urgently.
