Change of Employer

[E-3 Sufferer]

Hi,

What should we do if we want to change employer during PERM of I-140 stage?Should we take some permission from the current employer who filled your PERM or ask the new employer to contact the attorney filling up the PERM case?

Please note that job description will remain same with both employers.

On E-3 visa its impossible to change employer inside US therefore EB-2 is extrmely important.

Your PERM/I-140 are not portable to another company since the petitions are based on the POSITION at the company and not based on the alien. The only way you can port it is if you get an approved I-140 from your current company, and they agree not to withdraw it. Then, you would need to apply for a NEW PERM and I-140 at your new company, and then do a recapture of your I-140 priority date. That is the only way.

And I do not know anything about E-3 visas, so I don't know what the situation would be specific to your visa.
