Change of employer, change of address and change of job description

Here are the details of my case -

1. I-140 approved Nov, 2001
2. I-485 filed in July' 2002 INS Vermont
3. First FP done in August' 2002

I'm currently employed with the same company. However, I have an opportunity to join another co. in California, but in a different job title (changing from 'Implementation consultant' to 'product analyst'. ) at a higher salary. My questions are -

1. My FP should be due for a renewal soon. If I change my job next month, will this be affected?

2. Will my I-485 application be transfered to INS California? If yes, what does it mean? does it mean reprocessing of my I-485?

3. How risky is the change in 'Job Title' ?

4. How risky is the combination of change in 'job title' & 'change in location' ?

5. Is there any other factor that I should be aware of?

6. If I choose to join the new job, what steps should I take to ensure a smooth progress of my I-485?

A speedy response will be greatly appreciated !!

Thanks

--> shouldnt be - unless ur case is transferred

2. Will my I-485 application be transfered to INS California? If yes, what does it mean? does it mean reprocessing of my I-485?

--> May be to BCIS Calif or may be to local BCIS office. If it is transferred, it would not mean reprocessing of 485 from start though most probably would lead to a delay due to the transfer. Besides, I believe vermont is faster than Calif right now, so that may add to delay as well.

3. How risky is the change in 'Job Title' ?

--> Not risky

4. How risky is the combination of change in 'job title' & 'change in location' ?

--> Not risky

5. Is there any other factor that I should be aware of?

--> Change of Job Duties - that would be a problem. For AC-21, the job duties need to be "similar". BCIS has not explained what it means by similar, except that the job duties referred to O'NET classification. Check out: http://online.onetcenter.org/crosswalk_search

6. If I choose to join the new job, what steps should I take to ensure a smooth progress of my I-485?

--> Collect copies of I-140 approval and LC papers (especially ET-750 which has job description) and leave on a good note.

goodluck!

Job Description

Navinupur,

I dont think the Geographical Location is a problem. However 2 things I would be particular about is,

- Job Title
- Job Description

Not sure but I guess if you can talk to your new company they should be able to reword your offer letter.
