Hi Guys

I got my Labor (RIR-EB3) cleared and also my I40 cleared. My priority date is Mar-2004. Also my first six year H1 will expire by Jan 2008.

Now i am planning to change my job (new employer). I would like to know

1) As I have only a year left in my H1, is it advisable to change my employer now?

2) If I change, and my new employer is ready to do GC in EB2, is I am eligible to have my old priority date (Mar-2004).

3) Is it necessary that the job profile already given for EB3 and new EB2 should be same.

Thanks in advance

Answers below:

1. You may change employer. The new employer should apply for a 3-year H-1b if your PD is retrogressed.
2. Yes.
3. Not sure ... (Gurus, please help here)

Please note that in order to port the priority date the current I-140 should not be revoked.
