Change of Address question

I have recently moved to a new address. I have my I-485 pending with VSC, and am working on EAD with another employer. My H1-B expires in Feb 2003.

I have a couple of questions regarding AR-11 form :




1. What do I fill for the question "I AM IN THE UNITED STATES AS:" ?


2. What do I fill for the question "IF NOT A PERMANENT RESIDENT, MY STAY IN THE US EXPIRES ON :" ?

2. What do I fill for the question "IF NOT A PERMANENT RESIDENT, MY STAY IN THE US EXPIRES ON :" ?
Just enter:- Adjustment Applicant

For my second question, do I need to mention my H1B expiration date ?

My understanding is that you don't. I was in the same boat and I just put in "Adjustment applicant".
In most cases submission of AOS voids non-iimigrant status, with the exception of dual-intent classes ( H1-B and L ) I guess this should send us a message that for INS you being an adjustee is more important that anything else. Besides, you "STAY" in the US is governed by I-485 anyway... H1-B becomes more of a travel/employment autorization that anything else

Is it must to submit AR-11 form for address change?
Inform it to IIS officer is enough?
Will it effect if I mentioned my new employer in Ar-11 form.
Please give me an idea.

I too have some questions regarding the AR-11 form:

1. In the form, if you put the name and address of your new employer (using AC21), what is the probability that INS will compare it with your 485 documents and send an RFE?

2. Do both, my wife and I, need to submit the AR-11?

Yes it is mandatory. In fact, the law says that you should sumbit it within 10 days of address change regardless of whether you have pending applications at a SC or local office. Willful non-reporting is a federal offence and can lead to quite unpleasnt things including inprisonment and deportation. It's been rather controversial, because the law has never been enforced... but recently DOJ indicated that they are planning on doing so.
In reality AR-11 goes to INS HQ in DC and is recorded for "security" purposes. INS HQ then supposedly notifies a SC of the change of address so that all applications can be updated as well. This, however, never happens, so you will need to do it yoursels - talk to IIO and have them update your records.
So, basically - ironoically enough - it is illegal not to file AR-11, but filing brings you no benefit whatsoever( except you are not violating the law ), but it's quite legal to not notify the SC, however this is in your best interest...

Hi Folks,
My 485 is pending in VSC and I moved to houston,Texas.
If I change my address ,will INS transfer my case to Texas Service Center?.

From what I know, it may. Then again I have heard of cases when it didn't.
I'd say send AR-11 and talk to your lawyer about notifying SC.
 
My Client wants me to become Employee but the Job is based in a place out of VSC Area.. (Nebraska SC Area)

Shd I use AC-21...?

Shd I delay becoming Employee Couple of months to wait for Approval (Feb 02 RD) and then change Employment and rellocate?

Will be definate transfer case..if I change my Employer and move from NY to out of VSC Area...
