Change of Address Experience for I-485

Hi There,

I had to file my I485 from chicago due to my job there. Now that I have a EAD and an offer in Washington, I want to move there to be with my wife. Is it advisable to change the address with USCIS now especially since Chicago is so far behind for I-485? Any experiences here?

Thanks a lot!

I was told by my lawyer last time when I was still in process, that it's better not to move because you have to notify them and they would transfer the case to the new local DO. But use your judgement, which one is more important to you. If you don't mind waiting and get paid more, I would move; otherwise stay until you finish w/ your GC.

Thanks for your reply Mike. I have another question...since I am on a EAD now, is it safe to leave my H1 status, since I entered the US on a H1?

Regards and a Very Happy New Year!

You can work on EAD after 6 months of 485 receit date. So legally you are allowed and I did it myself and dont see any problem in switching the employers.

You can work on EAD the day it is approved. Where did you get this 6 month thingie from?

Having an EAD and using it for work are two different things. You could have an approved EAD and still continue to work on H1. If you havent used your EAD, you can work on H1 as long as it is valid. If you showed your EAD to your employer and switched to using an EAD, then you no longer are on H1.

And to answer your question, YES, it is safe to switch over to EAD, but that is a choice you make.

I see what you mean. If you are talking about AC21 Portability, it does not apply here as this is a family based GC and not an employment based GC.
