Change of address, etc.

Hi,

I'm in Boston, MA. My I-485 is currently pending - awaiting the name check results. My receipt date is 4/15/2005. I recently decided to go back to school in NC.

My questions are as follows:

1. If I get update my address with USCIS, how many additional months will it add to the already late GC process? Is it better to give a friend's address here in Boston and move? Will it have any other negative effect on my green card processing?

2. I'm currently on a valid H1-B. Since I'll stop working to go back to school full-time, what will my visa status be? I have already applied for EAD renewal and AP. Will that be sufficient or should I apply for any visa?

3. Should I go to the Boston office and ask the officers what the hell is going on with my i-485 and see if they'll expedite the process? (I know it sounds stupid, but I'm kinda frustrated)

Btw, my wife is a USC and she's sponsoring me for the GC.

Depends on how the processing times for your DO in NC are. As per law you have to file AR-11 everytime you change address. If your sponsor also changes address, the I-865 must be filed. If you dont change your address with USCIS for whatever applications you have pending with them, there are high chances you might have problems getting notices sent out by them. Also, you may have to travel back to boston for your interview

You wont be on H1-B as you will be quitting your H1-B job. Since you filed your I-485, you are in a legal status called "Pending AOS"

You can try it, not sure of the success rate

I recently saw online that my i-485 application was last updated on 4/18/06 after a year of no change in "last updated" date. The status is the same, though. I had called USCIS on 4/13/06 to update my address (I'd moved to a new apt.). I got a letter dated 4/14/06 stating that my new address has been updated in the system and that if I don't hear back anything about my pending i-485 application for another 6 months, I should contact them. I was wondering if the update on my i-485 case status that happened on 4/18/06 is just an address change or should I hope to hear some good news?
 
You mentioned that you are going back to school. I was wondering, if you are applying as a resident or international student? I assume you still don't have your green card, so how do you do that? Does EAD let you go to school at resident's tuition rate?

The school clearly asks if you're a perm resident, which I'm not. Therefore, I won't be eligible for any perm residents' benefits. The only alternative for me is to be an international student. But in my case since I'll have EAD and AP, I won't need an I-20 to enter/exit the US. That's the only difference. So, in short: I'm neither a full international student, nor a full perm resident, and it really sucks.
 
I think the "update" on your 485 online, is the address change. If you already went through an interview, then you move to another state, I was wondering if they will do another interview for you and your wife in NC office after a few monthes. They will probably transfer your case from Boston to NC office. I'm currently meeting almost the exact same situation here. Very frustrated and worried.
