Change more marital status while I130 pending

Hi Folks,

I have a questions. My father (GC holder) sponsored me back in 2001. At the time of sponsorship I was unmarried son over 21. However, I just got married. I have not formally notied USCIS about the change of my marital status. My father has his N-400 in process and hopefully within in the next few months he will become a citizen.

My plan is that when he becomes a citizen he will notify USCIS about the change in his status which will put me in First pref as per USCIS records and at that time I will notify USCIS of the change in my marital status which will hopefully put me in the Third Pref with the same priority date (april 2001).

Am I thinking right or the day I got married my I-130 became invalid and my father has to re-sponsor me when he gets his citizenship.

The day you got married your I-130 was voided. You should've waited until your father became a citizen. He needs to file a new petition.
 
I don't think he can file a new petition as a permanent resident to sponsor a married son over 21. From what I know, there is no such preference.

If the PR could file for a married son (doesn't matter over 21 or under), then your father's petition voudn't be voided in the first place. :rolleyes:

Of course. I thought it was obvious since your first posting ended with: "... and my father has to re-sponsor me when he gets his citizenship."
 
Can beneficiary get married once petitioner is citizen?

Hi,

I am the beneficiary of a petition my mother filed as a PR. She has just become a Citizen. Would the petition be void if I get married now? Would I be demoted to a different category, or would things progress as usual? My petition has been "approved" by USCIS, but I am waiting on a visa opening. Would my to-be wife be included too?

Thanks in advance if you can take out some of your valuable time for me.
 
You will move to 3rd preference as a result of getting married after your mother became a citizen. That means you'll need to wait a few extra years. However, the good news is your spouse will be able to join you and also get a green card. Whereas if you remained single so you could get the GC faster, and then got married after the GC approval, your spouse could not join you (you'd have to file for her and wait 4-5 years).
