My PERM and I-40 has been approved under EB3 (accountant position) and I cannot file I-485 due to retrogession (PD Nov 2005). My company is going to promote me as accounting manager and I have few questions that hopefully you guys can help me to answer:
1. Can I accept the promotion while my greencard is still in process? Is it OK for me to work as accounting manager and when I am eligible to apply for I-485, I will just return to my previous position? or do I have to redo all my greencard process again (new PERM and I-40)?
2. Do I have to amend my H1B to the new position? I am planning to apply 3 year extension based on approved I-40 (old position) next year.
