Change in job function after Green Card

Hi Friends,

I know people might have asked this question before but I am still asking as I could not find any relevant answer to my case.

Here is my case..
I have obtained my green card under EB1 - Multinational Manager. I worked for one of the largest multinational offshore IT company as a SAP Manager in India around 5 years and then I came to US in Nov 2004 on L1A Visa through the same company. They have filed my GC in Dec 2005 under EB1 - Manager category and I got GC in Aug 2007 and I continued working for them until March 2009. In March’09, there was a major lay-off and I could not survive in that lay-off. HR issued a letter stating that "You are terminated from the employment and the reason for terminations is Lay-Off. You severance package is so and so ….”. HR also mentioned I could go and apply for unemployment benefits. Fortunately I got a job offer within two weeks of my Lay-off so I did not apply for un-employment benefits.

Now my new job title is SAP Senior Functional Analyst (But I get higher pay now). Basically I am an individual contributor now and not in a manager role though I directly reports to Senior IT Director.

My questions:
1. Will this impact my Citizen application anyway?
2. I am planning to visit India this year. Will it create any problem at POE if I am asked?
a. Whether I am still working for my GC sponsoring employer?
b. What is my new job function?
I hear all kinds of news about people POE experience because of bad economy hence I am asking this question.
I appreciate your help on this.

Your new job will absolutely not have any impact on your GC or any future citizenship application. You worked long enough with your GC sponsor in good faith and you are now free to work any job or even not work at all. Sponsorship of your GC is not at all likely to come up at POE.

Answer to No 1: No issues at all because you are now a green card holder :) You are free to apply for US citizen in Aug 2012, but obey the immigration rules and meet eligibility conditions if you want to apply for US citizenship. Do not risk breaking the continuity of your required continuous residence in the United States. Do not risk getting traffic citations or do not break any law. :) You can check out the information about N-400 requirement and Naturalization guidelines. (everything is there at USCIS website including exam assessments).

Answer to No 2: You are a permanent US resident, no issues at all. You are free to travel and come back here, but do not stay outside USA too long like 6 months or you would be no longer a US permanent resident.

After you got your GC, it will have nothing to do with your current job or future job if you apply for US citizenship. If you are laid off again after you got GC, you can still apply for unemployment benefits and you apply for US citizenship. Enjoy whatever you do! Good luck! :)

This is really a great forum and great help for new immigrants. My salute to all the people who extends thier avdise to this group of people.
