Change from H4 to H1 and VISA Stamp in India

Hi ,

I came to US on H4 VISA (Multiple Entry) issued at US Consulate at Mumbai.

I started working once Iw as in US on change of Status as H4 to H1.

I am going to India and need to have H1B VISA stamp on my passport.

I am looking know what precautions that I should have Or Are there any problems / issues when considering my situation ?

I am working and have been getting regular pay checks too since I started working on H1B.

H4 start date Jan 04 can I apply for H1

Hi all,


My question is can I apply for H1 while i am expecting a H4. Actually, my wife's H1 is under process and the same time i have submitted my docs for h4. But my wifes H1's start date is Jan'04 as she is PT period now.

Now i am positive of getting H1 but i have submitted my papers and they said my h4's start date also same as my wife's H1 That is Jan 04.


Any any body suggest me that can i go ahead for H1 even though I have just applied fo rH4.

One more question is While on H4, can I apply for H1, no matter of time, I mean how long you are H4.
