Change from F1 to H1B Visa how long?

pt2003

I am in my F1 visa currently doing my OPT, which will expire by June 30, 2003. I want to change to H1 B Visa as I want to work in my profession.
1. Will the H1 B visa take a long time for me to stay in the US legally??
2. Could I apply as a J1 Visa to stay in the US??
3. Could I apply in another program to stay as an F1 Status is that possible??
Could anyone tell me what would be a better option, I would really appreciate it.
Thanks

H1B requires an employer who is willing to sponsor you. That means you first need a job offer. Regarding J1, there are several types, including J1 researcher, J1 student etc. Some of the J1s would require an employer sponsorship. F1 requires you to be admitted into another program.

It is unclear whether you currently have a job or not. Also is your aim to stay in the US no matter what, rather than getting permission to work? If you clarify your intentions, then it might be possible to comment further.

Thanks Raj for your reply, I am employed currently but only for a temporary position. The problem is finding companies to sponsor me and that time is running out. Yes, I do want to stay here in the US since I have completed my degree, I want to practice what I have learned and I dont know which option is better for my current situation.

If you find an employer, and the employer files an H1B before your OPT expires, then you can continue to stay in the US even after your OPT expires. But you cannot work for the company until the H1B petition is approved. For an extra $1000 you can go for premium processing of the H1B petiiton, and this can be paid by either you or the employer. This takes < 15 calender days for processing.

Some J1s are subject to the two year home residency requirement, so watch out.

All three visa types - H1, J1, and F1 are possible but would require job offer/admission to school etc.

Raj thanks once again, if I get an employer before my OPT expires, do u think I can work since I am still in status, as they are processing the H1 B??
Thanks for all the information, I appreciate it.

Unfortunately, no. You either need to be in OPT or the H1B approval in order to work. But you can offer to pay the $1000 premium processing fee yourself, and get the approval in under 15 days (but first try to convince the employer to pay). Your salary will make up for the $1000. If you sit at home and wait for the H1 approval for 3 months, you lose 3 months of salary, which is hopefully much more than the $1000.
